In addition, on the same day that Ms. Rich was attacked by Franz, the dog was found to be loose and the dog charged animal control as well. The Animal Control Report by J. Crickenberger stated in part:
“Observed female black lab with purple collar. No ID. Loose at C/A. Dog ran to front porch area. I attempted to contact at door, no response. Female black lab with purple collar showed A-Type behavior by charging at me. I had to use snare to capture dog safely.”
Despite defendant’s acknowledgement and awareness of his dog’s vicious nature, and history of charging and attacking people, Paul Stevens failed to confine his dog. He allowed his dog to run free and attack Ms. Rich.

IV. INJURIES
Immediately after the incident, Ms. Rich had severe low back pain. She took Motrin and Flexeril for the pain hoping she would get better. When she grew worse with left side radiating pain she went to the emergency room where she was given pain medication, referred to follow up with orthopedics, including an MRI. Records are referenced herein.
Following the emergency visit, Ms. Rich was seen by orthopedic surgeon Roland Nakata, M.D. Dr. Nakata ordered a lumbar MRI, a copy of which is referenced herein. Dr. Nakata’s records are also referenced herein.
On April 9, 2006, Ms. Rich was examined by Randall Armstrong, M.D., with Sacramento Diagnostic & Spine Center. The diagnostic impression of Ms. Rich stated:
“1. Acute significant teardrop disc herniation at 4-5 adversely affecting the left L5 nerve root.
2. Possible acute contained disc bulge central, maybe a little bit to the right, giving him some paresthesias in the right lateral foot. This is at L5-S1.”
Dr. Armstrong referred plaintiff to Mark Hambly, M.D. Copies of Dr. Armstrong’s records are referenced herein.
Dr. Hambly evaluated Ms. Rich on April 12, 2006, and presented her with the option of surgery. Those records are referenced herein.
Prior to her surgery, plaintiff treated at Smallie Chiropractic. Those records are referenced herein.
On May 31, 2006, Ms. Rich had the following operation performed by Mark F. Hambly, M.D., and assisted by Randall W. Armstrong, M.D.:
“Left L4-5 microdiskectomy utilizing operating microscoped.”
